  • Refunds are handled in accordance with Shopify's billing policies
  • We reserve the right to modify pricing with 30 days' notice; continued use after the notice period constitutes acceptance

  • 5. Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Display misleading, deceptive, or fraudulent content in checkout
  • Collect customer data beyond what is necessary for your business
  • Interfere with the proper functioning of the App or Shopify platform
  • Create checkout functions or rules that violate Shopify's terms of service or payment processing regulations
  • Use post-purchase offers to misrepresent products, pricing, or discount terms
  • Exploit targeting or personalization features in a discriminatory manner

  • 6. Merchant Responsibilities

    6.1 Content

You are solely responsible for all content displayed through the App, including text, images, offers, discounts, and product recommendations. You must ensure that your content is accurate, not misleading, and complies with applicable consumer protection laws and advertising standards.

    6.2 Checkout Functions

When configuring checkout functions (discount rules, payment rules, shipping rules, delivery rules, and validation rules), you are responsible for ensuring these rules operate correctly and do not create a misleading or unlawful checkout experience for your customers.

    6.3 Post-Purchase Offers

When using post-purchase funnels, you acknowledge that accepted offers are added directly to the customer's existing order and charged to their payment method. You are responsible for:

  • Clearly communicating offer terms, pricing, and discounts to customers
  • Honoring all discounts and offers presented through the App
  • Handling fulfillment of products added via post-purchase offers
  • 6.4 Third-Party Integrations

When you connect third-party platforms (such as Klaviyo, Mailchimp, Postscript, Recharge, or loyalty platforms) for audience-based targeting, you are responsible for:

  • Maintaining valid API credentials and authorization
  • Ensuring your use complies with each platform's terms of service
  • Having appropriate legal bases for sharing customer data with these platforms
  • Informing customers about how their data is used across connected platforms
  • 6.5 Data Protection

You are responsible for ensuring that your use of the App complies with applicable data protection laws (including GDPR, CCPA, and similar regulations) and that you have appropriate legal bases for processing customer data through targeting, personalization, and upsell features.

    7. Data Processing

By using the App, you acknowledge that we process certain data on your behalf. Please refer to our Privacy Policy for details on how we handle data, including what customer data is processed, how analytics are collected, and how third-party integration queries work.

    8. Intellectual Property

The App and its original content, features, functionality, templates, and component library are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Content you create using the App (such as checkout content blocks, upsell configurations, post-purchase funnels, upsell strategies, and experiment setups) remains your property.

Templates provided through the App's template library are licensed for your use within the App. You may customize templates freely for use on your store but may not redistribute or resell them independently.

    9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability.

The App depends on Shopify's platform and APIs, including checkout extensions, post-purchase extensions, and checkout functions. We are not responsible for disruptions caused by Shopify's services, API changes, or platform updates.

Post-purchase offers in particular rely on Shopify's post-purchase extension infrastructure. Availability and behavior of post-purchase features are subject to Shopify's platform capabilities.

    10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Without limiting the foregoing, we are not liable for:

  • Revenue lost due to misconfigured targeting rules, checkout functions, or upsell strategies
  • Customer disputes arising from post-purchase offers or discounts
  • Issues caused by third-party integration failures (Klaviyo, Mailchimp, Postscript, Recharge, loyalty platforms)
  • Inaccurate product recommendations from AI or rule-based systems
  • Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

    11. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that AI product recommendations will be accurate or optimal, that A/B test results will be statistically significant, or that checkout functions will produce specific business outcomes.

    12. Termination

You may terminate your use of the App at any time by uninstalling it from your Shopify store.

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms or for any other reason at our discretion.

Upon termination, your data will be deleted in accordance with our Privacy Policy. Active experiments will be stopped, post-purchase funnels will be deactivated, and checkout functions will be removed from your checkout.

    13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via the App or email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

    14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
